By downloading, accessing, or using the FocusDown mobile application (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
FocusDown is a productivity application that provides tools for focus management, session tracking, and related features. The specific features and functionality of the Service may change from time to time at our sole discretion.
Certain features of the Service require a paid subscription. Subscriptions are billed on a recurring basis and automatically renew unless canceled at least 24 hours before the end of the current billing period. Payment is processed through the Apple App Store. You may manage or cancel your subscription through your device's account settings.
Pricing, features, and subscription tiers are subject to change. Any unused portion of a free trial period will be forfeited upon purchase of a subscription.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to misuse, interfere with, or attempt to gain unauthorized access to any part of the Service.
All content, features, functionality, and materials available through the Service — including but not limited to text, graphics, logos, audio, animations, and software — are the exclusive property of FocusDown and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent.
The Service may integrate with or contain links to third-party services. We are not responsible for the availability, content, or practices of any third-party services. Your use of such services is governed by their respective terms and policies.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOCUSDOWN, ITS AFFILIATES, OFFICERS, DIRECTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may discontinue use of the Service at any time by uninstalling the application.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or other appropriate channels. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes.
